The decision in Manolete Partners plc v Ellis has recently been published here
The decision deals with and provides a review of wrongful trading, preference and transactions at an undervalue and also touches upon directors duties. It is interesting due to the fact that two of the claims failed but one succeeded and the position on costs will be interesting. The major claim of wrongful trading in a sum in excess of £6,500,000 failed confirming that wrongful trading claims are particularly difficult to bring.
The claim for preference succeeded but in a sum in excess of £180,000.
